Terms & Conditions of Use for Making Tax Digital (MTD) VAT Return Software

Rubicon Computer Systems Ltd has developed an application to allow users of the Rubicon Enterprise and Enterpro Accounting systems to submit a VAT return using HMRC API’s. Our solution is compatible with Making Tax Digital.

This Terms & Conditions notice applies to the MTD VAT Return software offered by Rubicon Computer Systems Ltd incorporated in England with company registration number 1240006.

Registered address is Rubicon House, Lamdin Road, Bury St Edmunds, Suffolk.  IP32 6NU

This software is only available to companies who use the Financial package as part of a Rubicon ERP system and is licenced to that customer on an annual basis.

Rubicon does not market this as a stand-alone application, and the software is only available directly from Rubicon.

This solution also requires software to be installed on to a p.c., with a valid licence/activation key.

The software which Rubicon has developed is supplied to existing Rubicon customers for the purpose of submitting a VAT return, with data from their existing Rubicon Accounting system.

Rubicon will issue an invoice for the annual licence cost to submit a VAT return for the VAT registered Company or Companies detailed on the invoice.

On receipt of payment of the invoice, Rubicon will issue a licence/activation key.

This allows the software to function for twelve months, for the purpose of submitting a VAT return using data from the Rubicon Accounting system.

Once a licence key has been provided for the next twelve months, no refund either in part or full will be issued.

If the MTD software is un-installed, re-installed or installed on to a different p.c. then a new activation key should be requested from Rubicon.

This replacement licence key will be issued without charge providing we are satisfied this is for the original agreed purpose e.g., to submit a VAT return for the Company named on the original invoice.

A licence key will only be provided to a known contact e.g., the IT Manager or Finance Director, with who we have an existing relationship.

The Rubicon MTD application will not function as a “stand-alone” application or without a valid licence key.

The customer must agree to not copy, modify or distribute the Rubicon MTD software application, and it must only be used to submit a VAT return for the agreed Company/Companies named on the invoice for the annual licence.

All Rubicon Software is licenced on a non-transferrable agreement, so in the event of a Company changing its name, or being bought or sold, a new licence key will need to be requested.   A licence transfer fee may be charged.

As this software is installed on to a p.c. it is the responsibility of the Customer to make sure that there is no unauthorised access or use of this software.

As use of this application is only made available to existing Rubicon Customers, support and training is offered as part of the Customers existing Support Agreement.

The Rubicon MTD VAT return software remains the property of Rubicon, the Customer is only being granted a licence to use the Software for twelve months.  All intellectual property rights remain with Rubicon Computer Systems Ltd.

Rubicon cannot be held responsible for any values submitted to HMRC as part of a VAT return using this Rubion application.  The customer is also solely responsible for complying with VAT reporting regulations.
